The Buyer Initiates the ArtEscrow Transaction.
The Buyer initiates the ArtEscrow by filling out the form Initiate ArtEscrow and sending ArtAmerica a check for the purchase price of the Art, plus the Buyer's ArtEscrow Fee.
Upon receipt of the Buyer's Initiate ArtEscrow form, ArtAmerica will send an Open ArtEscrow message to the Seller. Upon receipt and clearance of the Buyer's check, ArtAmerica will send the Seller the Shipping Instructions and a check request for the Sellers ArtEscrow Fee. Upon receipt and clearance of the Seller's ArtEscrow check, we will inform the Buyer that the ArtEscrow is funded. Upon receipt and inspection of the art, ArtAmerica will forward the art to the Buyer. When ArtAmerica receives notice from the Shipper that the art was received by the Buyer, the Buyer has 48 hours to notify ArtAmerica of their intention to return the art and recover their purchase price. After 48 hours with no Buyer Notification of Return, ArtAmerica will send a check to the Seller for the selling price of the art.
The Buyer may
Return the art
for a Refund.
The Buyer has the right to return the art, for any reason, within 48 hours of receipt. The Buyer must notify ArtAmerica within 48 hours, that they want a refund of their purchase price. The Buyer will receive confirmation of their Notification of Return and will be sent Return Shipping Instructions. The Buyer then ships the art (and pays for shipping and insurance) to ArtAmerica. The Seller is notified that the Buyer intends to return the art. Upon receipt and inspection of the returned art, ArtAmerica will ship it to the Seller. After 48 hours, following the delivery notice by the Shipper, ArtAmerica will send a refund check to the Buyer.
What if the
Seller Reneges
on the Sale?
If the Seller fails to send both the art and the Seller's ArtEscrow Fee to ArtAmerica, the transaction is void and a refund will be sent to the Buyer. The Seller has 48 hours to ship the art and forward their ArtEscrow Check (4 days for ArtAmerica to receive them) before ArtAmerica will close the transaction.
Who Pays for Shipping?
The Seller pays for the packing and shipping of the art to ArtAmerica and is responsible for any claims or damage by either ArtAmerica or the Buyer. Upon receipt of the art by ArtAmerica, it is inspected, photographed, and repackaged. ArtAmerica pays for the insured shipment to the Buyer using the Seller's ArtEscrow fee. If the Buyer returns the art, they are responsible for the cost of shipping it to ArtAmerica. ArtAmerica pays for the final return to the Seller using the Buyer's ArtEscrow fee.
How much is the Buyer's ArtEscrow Fee?
The ArtMart Buyer initiates and essentially pays for the ArtAmerica ArtEscrow Service. The fee is a basic minimum for handling plus a small percentage of the purchase price. The specifics of the fee is available @ ArtEscrow Fees.
What's the Seller's ArtEscrow Fee?
The Seller's ArtEscrow Fee is twice the insured shipping costs from the Seller to ArtAmerica. This is to insure the good faith of the Seller and to cover ArtAmerica's shipping and handling expenses, particularly in the event of the return of the art by the Buyer. The Seller may incur additional packing costs if ArtAmerica determines that the packaging of the art is insufficient to insure its safety. The Seller's ArtEscrow Fee can be estimated by the chart @ ArtEscrow Fees or determined by the actual packaged art, shipped via UPS or FedEx insured two day service.
Any other Conditions or Restrictions?
Any glass must be removed prior to shipment. The originator of the shipping is responsible for the art until accepted by the recipient. The recipient must refuse the shipment if the packaging or the art is damaged during shipment. If the damage is not discovered until after the delivery person has left, the recipient must contact ArtAmerica and also initiate a claim with the shipper. Any disputes between Buyer and Seller will be resolved by ArtAmerica.
